By accessing or using the Podelf website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Podelf is an AI-powered platform that helps podcasters repurpose their audio and video content into marketing assets, including show notes, blog posts, social media content, transcripts, and more.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Content Ownership

  • Your Content: You retain all ownership rights to the podcast audio, video, and other content you upload to the Service. By uploading content, you grant us a limited license to process it solely for the purpose of providing the Service.
  • Generated Content: Content generated by the Service (show notes, blog posts, social media posts, etc.) belongs to you. You may use, modify, and distribute it as you see fit.
  • Our Content: The Service, including its design, features, and underlying technology, is owned by Podelf and protected by intellectual property laws.

5. Acceptable Use

You agree not to:

  • Upload content you do not have the right to use or distribute
  • Use the Service to generate harmful, misleading, or illegal content
  • Attempt to reverse-engineer, decompile, or disassemble the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use automated systems or bots to access the Service in a manner that exceeds reasonable use
  • Resell or redistribute the Service without our written consent

6. Credits & Billing

  • The Service uses a credit-based system. Credits are consumed when processing audio/video or generating content.
  • Free credits are provided upon account creation and are non-transferable.
  • Paid subscriptions renew automatically. You may cancel at any time before your next billing cycle.
  • Refunds are handled on a case-by-case basis. Contact us within 7 days of a charge for refund requests.
  • Unused credits from monthly subscriptions do not roll over to the next month unless otherwise stated.

7. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content. While we strive for accuracy and quality, AI-generated content may contain errors, inaccuracies, or unintended outputs. You are responsible for reviewing and editing all generated content before publishing or distributing it.

8. Service Availability

We aim to provide reliable, uninterrupted access to the Service, but we do not guarantee that the Service will be available at all times. We may suspend or discontinue the Service or any part of it at any time, with reasonable notice when possible.

9. Limitation of Liability

To the maximum extent permitted by law, Podelf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Podelf, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service or your violation of these Terms.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
